Data Collection, Usage & Privacy Policies

The purpose of this Privacy Policy is to provide transparency around how we collect information online, in connection with our Services.

We are committed to respecting and protecting the privacy of all individuals with whom we interact and to fostering user confidence in online advertising.  Accordingly, we support and promote relevant industry guidelines.

Newsletter subscribers

If you opt-in to subscribe to our Newsletter list then we will collect your name and email address. This information will be used to share insights and more through our newsletter with you and the services that we offer. We may on occasion use this information to share new promos and services that might be of interest to you.

Personal information

The information that our clients or website visitors submit on the contact form will be used as an effective way to respond to the inquiry. This information includes your Name, Phone Number and Email address (but are not limited to the above) which will be stored in our email accounts and CRM software, both of which are password protected. You will not be added to any of our email lists unless you opt-in separately.

Your personal information is not shared with any external parties (person or business) without your written consent. You may choose to correct, update or remove the personal data you have submitted to us by contacting us via email or via the website.

Security

The security of personal data we take very seriously and always do our best to comply with applicable data protection laws. We will implement and maintain appropriate technical and organisational measures to protect the security and confidentiality of the personal data. Our website is hosted on a secure server environment that uses a firewall and other advanced security measures to prevent interference or access from outside intruders.

Encryption

Transport layer encryption is used to protect all connections to and from websites with SSL certificates (HTTPS). All new websites and web applications (business management systems) developed by Digital Fusion are issued with SSL certificates.

Non-Personal Information Collected by our Services

When conducting Services on behalf of its clients, we collect non-personally identifiable information (“Non-PII”) which anonymously identifies users that we may have interacted with before.  For instance, by using Non-PII, we may be able to identify whether a web browser has previously been served with an advertisement that we launched on behalf of a client.  In the context of Non-PII, whenever we refer to ‘you’ or ‘yours,’ please remember that we may be referring to a user’s browser profile and not an identifiable person since we do not know the identity of the user of an internet enabled device at any particular time.

We collect and use Non-PII to offer a range of Services to our advertiser clients.  By collecting Non-PII regarding your web browsing, usage or interactions with advertisements, our clients are able to show you the most useful and relevant online advertisements across numerous websites, and to prevent excessive or repeated deliveries of the same advertisements.  For example, if a user browser’s profile indicates an interest in bicycle options, then our Services may help our clients deliver interest-based online advertisements to that user about a particular type of bicycle. In addition, Non-PII is also used for the purpose of research and analysis.

The nature of Non-PII collected may include information such as the type of internet browser used by an online user, the type of computer operating system used, the domain name of the websites visited before and after viewing an advertisement, and information related to websites and web pages a user is viewing when an advertisement is shown.

We collect Non-PII through the use of cookies, pixels and related technologies managed by our third-party partners.   A cookie is a file on your web browser that uniquely identifies your web browser and computer.  A pixel is a line of code which is used by a website or third party to match online activities to a particular computer or web browser.  The use of a pixel allows websites and Digital Fusion to record, for example, that a user has visited a particular web page.  In addition, Non-PII from an earlier browsing session or interaction may be included in the pixel.  Though Non-PII does not personally identify a specific individual, we are still committed to giving users the opportunity to exercise choice about the Non-PII we collect.

By hiring or engaging Digital Fusion Cape Town (Pty) Ltd, you agree that you abide by this Agreement and any additional that maybe offered to you by Digital Fusion. A client is the party described as such an any application or service order executed between Digital Fusion and the individual / company.

The parties agree as follows.

Definitions: Terms defined above have their assigned meanings and each of the following terms has the meaning assigned to it.

Website design

The acceptance of the quotation by Client signature implies that the below terms and conditions have been read and understood and accepted by the Client.

  1. Quotations to clients are only valid for a period of 14 calendar days from date of quote.
  2. a 50% non-refundable deposit of the overall product/Services will be payable prior to commencement of any work.
  3. Client understands that he/she/it is not entitled to any refunds for whatsoever reason.
  4. Digital Fusion shall only be obliged to commence with work upon the agreed project date and once payment reflects in their account as provided on the quotation. This includes the payment of any requested deposit. The agreed project date reflects the availability of Digital Fusion to attend to the Client’s request, should the deposit payment be made after the original agreed project date the availability of Digital Fusion should be reviewed and new project dates are to be agreed upon and/or delays be expected.
  5. Full and Final payment will become due and payable within 48 hours once website design is completed and Digital Fusion issued invoice.
  6. Any and all access codes to the website will be provided within 24 hours of final payment reflecting in the account of Digital Fusion. Should the client fail to make payment within 48 hours, Digital Fusion will retain the product/services as security for payment and the client will have no right to access and/or use same.
  7. Client shall be liable for Digital Fusion’s legal costs as between attorney and own client in the event that Digital Fusion has to approach an attorney or institute legal action for payment of their account or any other breach of these terms and conditions. The Client will also be liable for all tracing fees and collection fees.

Social Media Management & other execution of marketing & design services for the Client:

Any additional services requested and not provided for in the original quotation an additional quote will be provided of which full and final payment will become due and payable within 48 hours of the issued invoice by Digital Fusion. Additional services will not be rendered should payment not be received.
  6. Client shall be liable for Digital Fusions legal costs as between attorney and own client in the event that Digital Fusion has to approach an attorney or institute legal action for payment of their account or any other breach of these terms and conditions. The Client will also be liable for all tracing fees and collection fees.
